Terms of Service & Refund Policy

1. About FightBack NYC

FightBack NYC ("we," "us," or "our") is an informational tool that generates formal appeal letters for app-based delivery workers in New York City who believe their account was wrongfully deactivated.

FightBack NYC is not a law firm and does not provide legal advice. No attorney-client relationship is created by using this service. For complex legal matters, we recommend consulting a licensed labor attorney.


2. What Our Service Does

Upon payment, our service generates a personalized appeal letter based on the information you provide. The letter:

We make no guarantees regarding the outcome of any appeal. Results depend entirely on the platform's review process and the specific circumstances of each case.

⚠️ Important: NYC Local Law protections allow workers to appeal wrongful deactivations and may result in reinstatement and back pay if upheld. The city may also impose fines on platforms found in violation. These outcomes are not automatic and are subject to the platform's and/or DCWP's review.


3. Refund Policy

We charge a one-time fee of $15.00 USD per letter generated.

To request a refund for a technical failure, email us at Support@fightbacknyc.net with your name, email address used at checkout, and a description of the error. Include your Stripe session ID if available.


4. Your Information

The information you provide to generate your letter (name, platform, account ID, deactivation details) is used solely for the purpose of generating your letter. We do not store your personal information on our servers after your letter is delivered. We do not sell or share your information with third parties.

Payment processing is handled securely by Stripe. We do not have access to your card details at any time.


5. Accuracy of Information

You are responsible for ensuring the information you provide is accurate. We generate your letter based entirely on the details you submit. Providing false or misleading information may undermine your appeal and is your sole responsibility.


6. Limitation of Liability

FightBack NYC is an informational tool only. To the maximum extent permitted by law, we are not liable for any damages, losses, or outcomes resulting from the use of our service, including but not limited to failed appeals, continued deactivation, or loss of income.


7. Changes to These Terms

We may update these terms from time to time. Continued use of the service after changes are posted constitutes acceptance of the revised terms. The "last updated" date at the top of this page will reflect any changes.
